Appraisal Ai – Terms of Use
1. About these Terms
1.1 These Terms of Use govern your access to and use of Appraisal Ai’s websites, chatbots, tools and related services.
1.2 By using our services, you agree to be bound by these Terms and our Privacy Policy.
1.3 Appraisal Ai operates nationally in Australia and is based in Western Australia.
2. Nature of our service
2.1 Appraisal Ai provides:
- Automated property appraisal estimates based on data and information you supply.
- Services that may connect you with real estate agents, mortgage brokers, finance brokers, finance specialists, lending specialists, finance partners and other independent third-party service providers.
2.2 We do not:
- Provide financial, legal, tax or accounting advice.
- Act as your real estate agent or representative.
- Provide formal property valuations suitable for lending, tax or financial reporting purposes.
3. Automated estimates and your responsibilities
3.1 Estimates are generated using automated systems, external data sources and your inputs.
3.2 Estimates are for general information only and:
- Are not guarantees of sale price.
- May not reflect current market conditions or property‑specific factors.
- May differ from valuations or estimates provided by banks, valuers or other sources.
3.3 You acknowledge and agree that you use our estimates at your own risk and that you are responsible for obtaining independent professional advice (for example from licensed real estate agents, valuers or financial advisers) before making significant financial or property decisions.
3.4 We are not responsible for any loss arising from differences between our estimates and valuations or price indications provided by other parties.
4. Eligibility and user responsibilities
4.1 You may use the services only if you are at least 18 years old and have capacity to enter into a binding agreement.
4.2 You agree to:
- Provide accurate and complete information about properties and yourself.
- Only submit details for properties you are authorised to discuss.
- Keep your access credentials (if any) secure and not share them with others.
4.3 You must not:
- Use the services for any unlawful, fraudulent or harmful purpose.
- Attempt to gain unauthorised access, interfere with security or test vulnerabilities.
- Copy, scrape, reverse engineer or misuse our data, models, content or systems.
5. Agent, finance partner and service provider introductions
5.1 When you expressly authorise or instruct us (including as described in clause 5.6), we may introduce you to one or more real estate agents, mortgage brokers, finance brokers, finance specialists, lending specialists, finance partners or other independent third-party service providers that we consider suitable based on factors such as your location, property, circumstances or the services you have requested.
5.2 We do not guarantee that any particular agent, finance professional or service provider is the best or only option for your circumstances, and you remain solely responsible for deciding whether to engage their services.
5.3 When we make an introduction, we may share your contact details, property information, appraisal information and other information reasonably necessary to facilitate the introduction with the relevant third-party organisation so they can contact you and provide the services you have requested. This sharing may occur immediately upon receipt of your authorisation without any further confirmation.
5.4 We may receive fees, commissions or other commercial benefits from certain agents, finance partners or other service providers if you engage them or a transaction is completed. Such arrangements do not increase the amount you pay the third-party organisation unless expressly disclosed.
5.5 Agents, finance professionals, finance partners and other service providers are independent third parties and are not employees, representatives or agents of Appraisal Ai. Appraisal Ai is not responsible for:
- (a) the conduct, advice, recommendations, products, services, performance or omissions of any third-party organisation;
- (b) any agreement you enter into with a third-party organisation;
- (c) the handling of your personal information by a third-party organisation after it has been disclosed in accordance with these Terms; or
- (d) any outcome arising from your engagement with a third-party organisation.
5.6 You expressly authorise Appraisal Ai to arrange an introduction and disclose your personal information where you indicate that you would like to speak with, meet, be contacted by or be introduced to a third-party organisation.
Your authorisation may be provided by, including but not limited to:
- (a) clicking or tapping a button or link labelled (or substantially described as) "Meet an Agent", "Meet a Partner", "Connect", "Get Introduced", "Speak to a Finance Expert", "Book a Finance Consultation", "Book a Meeting", "Talk to a Finance Partner", "Speak to a Finance Specialist", "Request a Call", or similar wording;
- (b) submitting a form requesting assistance;
- (c) responding positively to one of our employees or representatives;
- (d) responding positively to an AI assistant or chatbot;
- (e) responding positively to an email, SMS or other electronic communication inviting you to speak with a finance professional, real estate agent or other service provider; or
- (f) otherwise communicating that you would like Appraisal Ai to arrange an introduction.
5.7 By providing your authorisation under clause 5.6, you expressly instruct Appraisal Ai to disclose your personal information to the relevant third-party organisation for the purpose of facilitating the requested introduction.
The information disclosed may include your name, contact details, property information, appraisal information, preferences, information you have provided during conversations with Appraisal Ai (including through our staff or AI systems), and any other information reasonably necessary to facilitate the introduction or provide the requested services.
5.8 You acknowledge that introductions and disclosures under this section may occur automatically and in real time after your authorisation is received and may occur without any further confirmation from you.
5.9 Once an introduction has been made, the relevant third-party organisation may contact you directly by telephone, SMS, email or other reasonable means regarding the services you requested.
6. Promo codes, referral partners and data use
6.1 From time to time, we may offer promo codes, discounts or offers in conjunction with referral partners.
6.2 When you use a promo code or referral link:
- We may share information you provide to Appraisal Ai (for example, your name, email address, property information and appraisal results) with the relevant referral partner.
- We expect partners to use your information only for limited purposes such as verifying the referral, providing any promised offer and reasonably related marketing or follow‑up.
6.3 Partners will handle your information in accordance with their own privacy policies, which may differ from ours. You are responsible for reviewing those policies before using a promo code or engaging with a partner.
7. Privacy
7.1 Our collection, use and disclosure of personal information is described in our Privacy Policy.
7.2 By using the services, you consent to our handling of personal information in accordance with that policy.
8. Communications
8.1 By providing your contact details, you agree that we may contact you by email, SMS or phone to:
- Provide your appraisal information and related updates.
- Discuss potential agent introductions where you have indicated interest.
- Send information about similar services, promotions or updates.
8.2 You can opt out of marketing communications at any time using the unsubscribe mechanism provided or by contacting us at hello@appraisalai.com.au. Service‑related communications may still be sent where necessary.
8.3 Where you request or authorise an introduction to a real estate agent, finance professional, finance partner or other third-party service provider, you consent to receiving communications from both Appraisal Ai and the relevant third-party organisation for the purpose of arranging and providing the requested services.
9. Intellectual property
9.1 All intellectual property in the services, including software, models, text, graphics, logos and content, is owned by or licensed to Appraisal Ai.
9.2 You are granted a limited, non‑exclusive, non‑transferable licence to use the services for your personal or internal business purposes.
9.3 You must not reproduce, distribute, modify, create derivative works from or publicly display any part of the services except as expressly permitted by these Terms or with our written consent.
10. Availability, data retention and backups
10.1 We aim to keep the services available and functioning, but we do not guarantee uninterrupted or error‑free operation.
10.2 We may modify, suspend or discontinue any part of the services at any time, including features or content.
10.3 We take reasonable steps to maintain backups and protect data against loss, but we do not guarantee that any particular appraisal or history will always be available. We recommend you keep your own copies of important information (for example, by saving or exporting key details).
11. Security and incidents
11.1 We take reasonable steps to protect the security of the services and your information, but no system is completely secure.
11.2 If we become aware of a security incident or data breach that is likely to result in serious harm, we will investigate promptly and, where required by law, notify affected individuals and regulators.
11.3 You are responsible for using appropriate security measures on your own devices and networks (such as up‑to‑date software and strong passwords).
12. Disclaimers and limitation of liability
12.1 To the maximum extent permitted by law, the services are provided “as is” and “as available”, and we exclude all warranties, representations and guarantees not expressly stated in these Terms.
12.2 Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies you may have under the Australian Consumer Law or other applicable law that cannot be excluded.
12.3 Subject to those non‑excludable rights:
- Our aggregate liability to you for all claims arising out of or in connection with the services or these Terms is limited, at our option, to: Resupplying the relevant services, or Paying the cost of having the services resupplied.
- We are not liable for: Loss of profits, revenue, goodwill or opportunity, or Indirect, consequential or special loss or damage, arising out of or in connection with the services, these Terms, any estimates or any engagement with third‑party agents or partners.
13. Third‑party services and links
13.1 The services may include links to third-party websites, tools or services, including real estate agents and referral partners.
13.2 We do not endorse, control or assume responsibility for third-party content, products or services. Your use of third-party services is at your own risk and subject to their terms.
14. Termination
14.1 You may stop using the services at any time.
14.2 We may suspend or terminate your access to the services at any time if we reasonably believe you have breached these Terms, misused the services or engaged in unlawful or harmful conduct.
14.3 On termination, clauses that by their nature should continue (including intellectual property, disclaimers, limitations of liability and governing law) will remain in effect.
15. Governing law and jurisdiction
15.1 These Terms are governed by the laws of Western Australia and the Commonwealth of Australia.
15.2 You submit to the non‑exclusive jurisdiction of the courts of Western Australia and any courts that may hear appeals from those courts.
